These Terms of Service ("Terms") govern your use of the website shishax.eu (the "Site") and the purchase of products through it.

The Site is operated by Andrés Felipe Duque Alvarez (autónomo), NIF ES-60928520W, (hereinafter "the Seller", "we", or "us").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Products and Brand

The products sold through this Site are branded under the ShishaX trademark, owned by SHX Corporation (a United States entity) and licensed to the Seller for distribution in the European Union. References to "ShishaX" or "VOLTA" throughout the Site refer to the product brand.

3. Age Restriction

All products on this Site are intended for adults aged 21 years or older. By placing an order, you confirm that you are at least 21 years old. We reserve the right to verify age and refuse or cancel orders if we have reasonable grounds to believe the buyer is underage.

4. Product Use

Products sold on the Site are heating accessories for use with traditional hookah setups. By purchasing, you agree to:

• Use products only in compliance with all applicable laws in your country of residence
• Follow all safety instructions in the product documentation
• Not use the products for any unlawful purpose

You are responsible for understanding the legal status of hookah accessories and tobacco products in your jurisdiction. Improper use may void your statutory warranty rights.

5. Ordering and Contract Formation

When you place an order, you make an offer to purchase. A contract is formed when we accept the order, which we confirm by sending an order confirmation email. We reserve the right to refuse or cancel any order before shipment, including in cases of pricing errors, stock unavailability, or suspected fraud.

All prices on the Site are shown in Euros (EUR) and include the applicable Spanish IVA (VAT) unless otherwise stated. Shipping costs are calculated at checkout based on destination.

6. Right of Withdrawal

As a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. Full details of how to exercise this right, including the model withdrawal form, are set out in our Refund Policy.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, product designs, and software, is the property of SHX Corporation, the Seller, or their licensors, and is protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, publicly communicate, reverse engineer, or commercially exploit any content without prior written consent.

9. User Submissions

If you submit reviews, feedback, or other content to the Site, you grant the Seller a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display such content for business purposes. You confirm that you own or have the rights to any content you submit.

10. Limitation of Liability

To the maximum extent permitted by Spanish and EU consumer law, the Seller's liability is limited as follows:

• Nothing in these Terms limits our liability for death, personal injury, fraud, or any liability that cannot be excluded under applicable law, including statutory consumer rights
• For other losses, our total liability is limited to the value of the order giving rise to the claim
• We are not liable for indirect or consequential losses, including loss of profits, data, or business opportunities

Statutory consumer rights are not affected by this clause.

11. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to natural disasters, government actions, carrier disruptions, strikes, or pandemics.

12. Marketing Communications

By providing your email address and opting in, you consent to receive marketing emails. You may withdraw consent at any time by clicking the unsubscribe link in any marketing email or contacting info@shishax.eu. Marketing complies with the requirements of Article 21 LSSI-CE and the GDPR.

13. Governing Law and Jurisdiction

These Terms are governed by Spanish law.

For consumer contracts, disputes may be brought before the courts of the consumer's country of residence within the European Union, in accordance with Regulation (EU) 1215/2012 (Brussels I bis). For non-consumer disputes, the courts of Barcelona, Spain shall have exclusive jurisdiction.

14. Online Dispute Resolution

In accordance with Regulation (EU) 524/2013, consumers may submit disputes to the European Commission's Online Dispute Resolution platform:

Our email address for this purpose is info@shishax.eu. We are not obliged to participate in alternative dispute resolution before consumer dispute bodies, although we are open to good-faith resolution of any complaint.

15. Changes to These Terms

We may update these Terms from time to time. The current version is available on this page with the date of last update. Material changes will be notified to registered customers by email or via a prominent notice on the Site. Continued use of the Site after notification constitutes acceptance.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.
